People v. Barragan, 2026 Cal. App. Unpub. LEXIS 6727 (Cal. Ct. App. 2026)
The California 6th District Court of Appeal held that the trial court in a resentencing petition must consider the youthfulness of a 20-year-old individual at the time of the offense. The court stated in relevant part:
Martell was 20 years old at the time of the crime. Impulsivity and vulnerability to peer pressure may have contributed to his participation in the unplanned group attack of a rival gang member. We find it is reasonably probable a more favorable result would have been reached on Martell’s petition had the trial court considered his youth. (Pittman, supra, 96 Cal.App.5th at p. 417 [applying prejudice standard from People v. Watson (1956) 46 Cal.2d 818].) We express no opinion on how the trial court should decide the issue on remand; we merely conclude it is appropriate to give the trial court a meaningful opportunity to consider Martell’s youth.
