[Florida] H.C. v. Bradshaw – Complaint

On June 21, 2018, a federal class action lawsuit was filed on behalf of young people confined in the Palm Beach County Jail, alleging violations of their 8th and 14th Amendment rights under the U.S. Constitution. The plaintiffs are youth whose cases have been direct-filed in adult court in Palm Beach County, Florida. The complaint alleges that these young people were subject to solitary confinement, deprivation of educational services, and violations of their rights under the Individuals with Disabilities Education Act (IDEA), Section 504 of the Rehabilitation Act of 1973, and the Americans with Disabilities Act (ADA). The complaint alleges that the Palm Beach County sheriff’s department and Palm Beach County School Board violated the children’s 8th Amendment right to be free from cruel and unusual punishment and 14th Amendment  right to procedural due process, in addition to their right to receive educational services and programming under the IDEA and their right to be free from discrimination under ADA.
